Terms of Service

By creating an account or accessing any part of BracketContest ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, incorporated herein by reference.

If you do not agree with any part of these Terms, you must not access or use the Platform. Your continued use after any modification constitutes acceptance of the updated Terms.

To use BracketContest you must meet all of the following requirements:

• Be at least 18 years of age (or the applicable age of majority in your jurisdiction, whichever is higher)
• Have the full legal capacity to enter into a binding agreement
• Not be prohibited from using the Platform under the laws of your country, state, or region
• Not have had a prior account terminated by BracketContest for a violation of these Terms

BracketContest reserves the right to verify eligibility at any time and to suspend or permanently terminate accounts that do not comply.

You must register an account to access certain features. When registering, you agree to:

• Provide accurate, current, and complete information
• Keep your credentials confidential and not share them with any third party
• Notify us immediately at [email protected] of any unauthorized use of your account
• Be solely responsible for all activity that occurs under your account

BracketContest reserves the right to reject or reclaim any username that violates these Terms or that we determine, in our sole discretion, to be inappropriate.

BracketContest is a free-to-play, skill-based sports prediction platform. Users compete by making picks on real sporting events. No purchase is necessary to participate, and no real money is ever wagered on the Platform.

Our services include:

• Pick'em contests for football, soccer, basketball, baseball, and other sports
• A global leaderboard and seasonal rankings
• BCP (BracketContest Points) rewards for signing up, verifying your account, referrals, and contest performance
• Social features including friend leagues and group competitions

BracketContest does not operate as a gambling or wagering service. All contests are based on skill, knowledge, and statistical analysis of sports outcomes.

BCP (BracketContest Points) is an internal platform currency used to enter contests and claim rewards. No cryptocurrency, blockchain, or digital wallet is involved. BCP can be earned free through signup, account verification, referrals, gameplay and platform engagement, and may also be purchased.

• BCP is not legal tender, not a cryptocurrency, and not a financial security
• BCP is not transferable between users
• BCP has no cash value outside the platform and can only be redeemed through the BracketContest reward program, subject to its rules and minimums
• Free contests remain available, and no purchase is required to take part in them
• Purchases of BCP are final, except where a refund is required by law
• Your BCP balance is stored in your BracketContest account and is visible in My Wallet

BracketContest reserves the right to modify the BCP reward structure, issuance rate, or purchase terms at any time with reasonable notice.

BracketContest contests are skill-based competitions where participants predict outcomes of real sporting events. Contest rules, scoring methodology, and prize structures are published within the Platform for each contest.

By entering a contest, you agree that:

• All picks are final once submitted and may not be changed after the contest lock time
• Official results are determined by BracketContest based on recognized sports data sources
• In the event of a tie, prizes may be split or resolved per the specific contest rules
• BracketContest may cancel, modify, or postpone any contest due to data errors, force majeure, or other circumstances, and will issue BCP credits accordingly

Winners of contests receive BCP credited to their account balance. BCP can be redeemed for gift cards through the Platform, subject to:

• A minimum redemption threshold as published in the Platform
• Verification of your identity before a redemption is fulfilled
• Manual review and processing by our team, which may take several business days
• Availability of the selected gift card denomination or brand

BracketContest reserves the right to withhold prizes or redemptions pending investigation if fraudulent activity, collusion, or violation of these Terms is suspected. All prize and redemption decisions by BracketContest are final and binding.

Availability of paid contests depends on applicable laws and regulations. Players are responsible for confirming eligibility in their jurisdiction.

You agree not to engage in any of the following prohibited activities:

• Creating multiple accounts for the same individual
• Using bots, scripts, or automated tools to gain competitive advantage
• Colluding with other users to manipulate contest outcomes
• Sharing, selling, or transferring your account to any other person
• Harassing, threatening, or abusing other users or Platform staff
• Submitting false, misleading, or fraudulent information
• Attempting to hack, reverse-engineer, or disrupt Platform systems
• Violating any applicable local, national, or international law or regulation

BracketContest may suspend or permanently ban any account found in violation, with or without prior notice, and may forfeit any associated BCP balance.

All content on the Platform — including logos, trademarks, software, graphics, text, and contest data — is the exclusive property of BracketContest Inc. or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for personal, non-commercial purposes. You may not:

• Copy, reproduce, or distribute Platform content without prior written consent
• Use BracketContest trademarks without authorization
• Create derivative works based on Platform content

By submitting any user-generated content (e.g., profile pictures, usernames), you grant BracketContest a worldwide, royalty-free license to use that content in connection with the Platform.

Your privacy is important to us. Our Privacy Policy, available at bracketcontest.com/privacy, describes how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described therein.

We implement industry-standard security measures to protect your data, but no method of transmission over the internet is 100% secure. You acknowledge and accept this inherent risk.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

BracketContest does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRACKETCONTEST'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE BCP CREDITED TO YOUR ACCOUNT IN THE 30 DAYS PRIOR TO THE CLAIM, OR (B) USD $50. IN NO EVENT WILL BRACKETCONTEST BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to defend, indemnify, and hold harmless BracketContest Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of these Terms
• Your use of the Platform
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit or transmit through the Platform

BracketContest reserves the right to update or modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify registered users via email or an in-Platform notification

Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive the right to participate in class action lawsuits against BracketContest.

Notwithstanding the foregoing, BracketContest may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
